This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and Argonaut Games, Inc. ("Publisher," "we," or "us") for the use of our video game ("Game"). By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this EULA. If you do not agree, do not install or use the Game.

1. Grant of License

Subject to your compliance with this EULA, Publisher grants you a non-exclusive, non-transferable, revocable license to install and use the Game on devices you own or control, solely for your personal, non-commercial use.

2. Restrictions

 

You agree not to:

• Copy, modify, or distribute the Game.

• Reverse engineer, decompile, or disassemble the Game.

• Create derivative works based on the Game.

• Rent, lease, or sublicense the Game.

• Use the Game for any commercial purpose.

 

3. Ownership

 

The Game is licensed, not sold. Publisher retains all rights, title, and interest in and to the Game, including all intellectual property rights such as copyrights, trademarks, and patents.

 

4. User Conduct

 

You agree to use the Game in compliance with all applicable laws and not to engage in any conduct that may disrupt the Game or harm other users. Publisher reserves the right to suspend or terminate your access to the Game if you violate this EULA or engage in any inappropriate behavior.

 

5. Termination

 

This EULA is effective until terminated. Publisher may terminate this EULA at any time if you breach any of its terms. Upon termination, you must cease all use of the Game and delete all copies in your possession.

6. Disclaimer of Warranties

 

The Game is provided "as is" without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. Publisher does not guarantee that the Game will be error-free or uninterrupted.

 

7. Limitation of Liability

 

To the maximum extent permitted by law, Publisher shall not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to this EULA or the use of the Game, even if advised of the possibility of such damages.

 

8. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any disputes arising under this EULA shall be subject to the exclusive jurisdiction of the courts in Frisco, Texas.

9. Updates to This EULA

 

Publisher reserves the right to modify this EULA at any time. Any changes will be posted on our website, and your continued use of the Game after such modifications constitutes your acceptance of the updated EULA.

 

10. Miscellaneous

​

• Severability: If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

• Entire Agreement: This EULA constitutes the entire agreement between you and Publisher regarding the Game and supersedes any prior agreements.

• No Waiver: Failure by Publisher to enforce any right or provision of this EULA shall not constitute a waiver of such right or provision.
